US

Consumers also have rights regarding online shopping, including the right to cancel a purchase if a seller fails to ship within the promised timeframe or within 30 days if no timeframe is specified. Furthermore, businesses cannot enforce non-disparagement clauses that prevent consumers from sharing honest opinions about their products or services on platforms like Yelp or social media.
While the principle of "caveat emptor" ("buyer beware") still applies in some contexts, modern consumer law has shifted toward a more balanced approach that prioritizes consumer protection and fairness. Legal remedies for violations include filing complaints with federal or state agencies, pursuing class action lawsuits, or seeking compensation through individual claims. Some states and cities have also enacted laws requiring businesses to accept cash payments, reflecting ongoing efforts to strengthen consumer rights
EEA
In the EEA, consumers are protected by a comprehensive legal framework designed to ensure fair trade practices and safeguard their rights when purchasing goods, services, or digital content. These rights are established through EU legislation, including the Consumer Rights Directive 2011/83/EU, which harmonizes national rules across member states to provide consistent protections regardless of where a transaction occurs within the EU.
Consumers have the right to clear, accurate, and transparent information before making a purchase, including details on the product or service, price, delivery costs, and terms of the contract. This applies to both physical and digital purchases, as well as services and experiences. When shopping online, consumers are entitled to a 14-day cooling-off period during which they can cancel their purchase for any reason without needing to justify their decision. This right extends to purchases made via distance selling, such as by phone, catalogue, or online.
If goods are faulty, not as described, or delivered late, consumers can demand a repair, replacement, price reduction, or full refund. A minimum 2-year legal guarantee applies to all new goods purchased in the EU, regardless of whether the purchase was in a shop, online, or through distance selling. For goods that break within the first year, it is presumed the fault existed at the time of purchase unless the seller can prove otherwise. If the fault is discovered after the first year but within the two-year period, the consumer still has the right to a remedy, though they may need to provide evidence that the defect existed at the time of delivery.
Second-hand goods bought from a trader are also covered by the 2-year guarantee and the 14-day cooling-off period, although national laws may allow for shorter minimum guarantees (as low as one year), provided this is clearly communicated at the time of sale. However, second-hand goods purchased from private individuals are not covered by EU consumer rules.
The EU also protects consumers from unfair contract terms and misleading or aggressive commercial practices. Terms that create a significant imbalance in the rights and obligations of the parties, to the detriment of the consumer, are considered unfair and unenforceable. The Unfair Terms in Consumer Contracts Directive 1993 and the Unfair Commercial Practices Directive 2005 reinforce these protections.
Consumers can seek assistance from the European Consumer Centres Network (ECC-Net) if they encounter problems with a business based in the EU, Norway, or Iceland. Dispute resolution options include informal settlement, alternative dispute resolution (such as mediation or online platforms), and formal legal action through mechanisms like the European small claims procedure.
The European Commission continues to work on modernizing consumer law to address challenges posed by digitalization, including strengthening rights related to accurate information, protection against unfair practices, and effective remedies when rights are breached. The "New Deal for Consumers" initiative, launched in 2018, aimed to update key directives and improve enforcement coordination among national authorities.
